Terms of Service

By downloading, installing, or using the Beacon mobile application (the "App") or any related services operated by Beacon ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

We may update these Terms from time to time. Continued use of the App after changes are posted constitutes acceptance of the revised Terms.

You must be at least 13 years old to use the App. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. By using the App, you represent and warrant that you meet these eligibility requirements.

To access certain features, you must create an account. You agree to:

• Provide accurate and complete registration information
• Keep your account credentials secure and confidential
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.

Beacon provides a festival companion platform that allows you to browse festival lineups, listen to artist previews, build personalized schedules, view festival maps, and connect with friends at events.

You agree to use the App only for its intended purposes. You may not:

• Use the App for any unlawful purpose or in violation of any applicable laws or regulations
• Attempt to gain unauthorized access to the App, other user accounts, or our systems
• Interfere with or disrupt the App's functionality, servers, or networks
• Reverse engineer, decompile, or disassemble any portion of the App
• Use automated systems (bots, scrapers, etc.) to access the App
• Harass, abuse, or harm other users through the App's social features
• Impersonate any person or entity or misrepresent your affiliation with any person or entity
• Use another user's location data to stalk, track, or harass them

The App offers location-based features, including festival maps and the ability to share your location with friends. By enabling location services:

• You consent to the collection and use of your location data as described in our Privacy Policy
• You understand that your location may be visible to users you have connected with as friends
• You can disable location sharing at any time through your device settings or within the App

You agree not to use location features to track, stalk, or harass any person. Misuse of location features will result in immediate account termination.

The App may provide access to music previews and other content from third-party services (such as streaming platforms). This content is provided for personal, non-commercial use only.

• We do not own the music or media content available through the App
• Third-party content is subject to the respective provider's terms of service
• Availability of content may change without notice based on third-party licensing
• You may not record, download, or redistribute any content accessed through the App

The App and its original content, features, and functionality are owned by Beacon and are protected by international copyright, trademark, and other intellectual property laws.

• The Beacon name, logo, and all related marks are trademarks of Beacon
• You may not use our trademarks without prior written permission
• You retain ownership of any content you submit to the App, but grant us a license to use it as needed to provide the service

By submitting content to the App (such as feedback, profile information, or other user-generated content), you grant Beacon a non-exclusive, royalty-free, worldwide license to use, display, and distribute that content in connection with operating and improving the App.

You represent that you own or have the necessary rights to submit any content you provide, and that your content does not violate any third-party rights.

The App displays festival schedules, lineups, maps, and other event information. While we strive for accuracy:

• Event information is provided by festival organizers and may change without notice
• We are not responsible for inaccuracies in event information, schedule changes, or cancellations
• The App is not a ticketing platform — ticket purchases are handled by third-party providers
• We do not guarantee the accuracy of real-time updates or crowd information

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The App will be available at all times or without interruption
• The App will be free from errors or defects
• Information provided through the App will be accurate or complete
• The App will meet your specific requirements

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BEACON AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR PERSONAL INJURY, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

You agree to indemnify, defend, and hold harmless Beacon and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising from your use of the App, your violation of these Terms, or your violation of any third-party rights.

We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination:

• Your right to use the App will immediately cease
• We may delete your account and associated data in accordance with our Privacy Policy
• Sections of these Terms that by their nature should survive termination (such as disclaimers, limitations of liability, and indemnification) will remain in effect

You may terminate your account at any time by deleting it through the App's Settings.

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved in the courts located in the United States.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
